Moustafa M., a Syrian national, allegedly joined ISIS in Syria in May 2015. As a member of ISIS, he allegedly assumed guard duties and participated in the arrest of civilians. According to prosecutors, in late May or early June, Moustafa M. and other ISIS fighters held two individuals captive for several hours. Moustafa M. and the other members allegedly threated to kill the victims if they or their family members did not cooperate with ISIS. Allegedly one month later, in June 2015, Moustafa M. is said to have taken part in the execution of two Free Syrian Army (FSA) fighters, after they had been issued a death sentence by ISIS. Moustafa M. allegedly transported the two captives to the execution site where he guarded them until their execution. Further, Moustafa M. Is said to have accompanied two other FSA fighters to their executions. One of them allegedly shot multiple times in the head, while the other one was dragged behind a vehicle until he died. On another occasion, Moustafa M. is said to have fired several shots at an unarmed person within short distance at a roadblock where the person was able to escape. Furthermore, he allegedly supported the occupation of a house seized by ISIS after the lawful owners had been expelled. Moustafa M. was arrested in Germany on 21 March 2023 and has been in pre-trial detention ever since. On 2 January 2024, an indictment was filed on counts of membership in a terrorist organisation, war crimes, and murder. Moustafa M. is standing trial before the Higher Regional Court Koblenz since 8 April 2024.
