The defendant, an Iraqi national joined ISIS in 2014 together with Raad Riyadh A., his father. Between 2014 and 2015, Abbas R. participated in executing a captive of ISIS, while humiliating and insulting the victim. In 2015, both Abbas R. and Raad Riyadh A. arrived in Germany where they were arrested in a separate case in May 2017. Abbas R. was underage when he committed the crime and thus prosecuted pursuant to juvenile justice. On 4 June 2021, Abbas R. was found guilty of membership in a foreign terrorist organisation and war crimes. He was sentenced to 5 years and 10 months imprisonment. Abbas R. and his father both appealed their respective convictions. The defendant’s appeal which was largely based on procedural issues was dismissed. His conviction and sentence were thus confirmed on appeal in December 2023.
